Procedures of notarization of real estate purchasing and selling contracts

Seller and buyer shall prepare such those documents, papers when go to the notary, as follow

SELLER:

  • Original drawing of the house;

NOTARIZE REAL ESTATE PURCHASE CONTRACT

The two Parties selected the notary office in the province / city where the land is located. Based on the agreement between the two parties, the Notary Office will prepare the contract of real estate purchase contract. Both parties will sign the contract in front of the notary and the Notary Public will check and confirm the legality of the contract.

  • Procedures to change the real estate’s owner name

After real estate purchase contract has been notarized, the buyer should prepare the file and carry out the following steps:

  • Documents for changing real estate owner’s name shall include:
  • Buyer’s ID card (01 copy);
  • Household registration book (01 copy);
  • Marriage certificate (original), or single certificate (original or certified copy);
  • Notarization contract (original);
  • Notarization contract (02 copies)
  • Land use right certificate and ownership of houses and other land-attached assets (original);

  • The drawings of the house and land diagram (Original);

Step 1: Fill in the application for land, land-attached asset change registration (form below)

Step 2: Submit the application for land, land-attached assets change registration and the above documents to the receptionist of the Land Registration Office at the place where the land is located.

Step 3: The officer will receive the application and give the receipt of the dossier which shows the date of return

Step 4: When the return date comes, you go to the Office and get tax notice

Step 5: Go to the tax office and pay tax according to tax notice

Step 6: Bring the receipt of full tax payment to the Land Registration Office and receive Red Book.
